    You are not allowed to and you agree not to use MEGHAA MODI web site (or any part of) for any illegal purpose. Any attempt by you to upload or transmit through our website any computer viruses, macro viruses, trojan horses, worms or anything else designed to interfere with, interrupt or disrupt the normal operating procedures of a computer is an offence punishable under law. You may not send/ upload or make available any mate- rial which is defamatory, offensive, or obscene, or that may cause annoyance, or inconvenience. The contents of this web site are copyright of MEGHAA MODI or of the respective owners as mentioned otherwise. The brand names including other trade impressions are the intellectual property of MEGHAA MODI. You may not use the web site in any manner which violates or infringes the intellectual property rights of or of any other person, firm or company.

    1. MEGHAA MODI has provided utmost security to the contents of the transactions and secured financial transactions contemplated through this web site. The security, accuracy and efficiency of the financial transactions are depending on the payment gateways. You may personally verify and get satisfied with the payment gateway chosen by MEGHAA MODI. MEGHAA MODI shall not be responsible for any omissions, failures, default or negligence in this regard.
    2. You are solely responsible in all respects for all use of and for protecting the confidentiality of any user name and password that may be given to you or selected by you for use on this web site. You may not share these with or transfer them to any third parties. You must notify MEGHAA MODI immediately of any unauthorised use of them or any other breach of security regarding this web site that comes to your attention. Any claims arising in connection with your use of this Website or any Content must be brought within one (1) year of the date of the event giving rise to such action. Your remedies are limited to those expressly provided for in these Terms and Conditions.

      We respect your personal information and undertake to comply with applicable Data Protection legislation and the privacy laws as applicable. At the same time, we shall be disclosing all available information as required by them if any investigating agencies including any regulatory or government authority investigating any suspected illegal activities, or upon receipt of a court order, requestor or direct us to provide your Personal Information and/or information concerning your activities whilst using the Website

  6. FRAUD

    Any party engaged in illegal activities involving the use of this website will be subject to civil and criminal sanctions and prosecution. MEGHAA MODI does not guarantee that it will be able to prevent any illegal or inappropriate use of this website, nor that it will give notice of any illegal or inappropriate use of this website. It is an illegal violation to place orders under a false name, with a fraudulently obtained credit card/ debit card or with- out the consent of the cardholder. You may take utmost care to preserve your credit/ debit card details to avoid such instances. It shall be your responsibility to take appropriate legal actions against all such fraudulent activi- ties. You agree to defend, indemnify and hold MEGHAA MODI, its affiliates, officers, suppliers and employees harmless from any and all claims, liabilities, settlements, costs expenses and actions both civil and criminal initiated by any third parties against MEGHAA MODI including without limitation, reasonable legal and accounting fees, arising in any way from your illegal and fraudulent use of credit card/ debit card and/or your illegal activities with regard to the use of this web site.

MEGHAA MODI shall provide notice to you promptly of such claim and shall reasonably cooperate with you, at your expense, in your defence of any such claim.

  9. GOVERNING LAW

    By accessing this Website both you and MEGHAA MODI agree that the statutes and laws of India without regard to conflicts of laws, principles thereof, will apply to all matters arising from or relating to use of this Web- site, and also agree to submit to the exclusive personal jurisdiction and venue of any Courts in Bangalore, India, with respect to such matters. Those who choose to access this Website from outside India do so on their own initiative and are responsible for compliance with local laws.

    MEGHAA MODI may change these Terms and Conditions from time to time and at any time, [with or without actual notice to you.] All such changes to these Terms and Conditions will appear on this page of the Website. By using the Website following any modifications to these Terms and Conditions, you agree to be bound by any such modifications to these Terms and Conditions.

  11. AVAILABILITY OF THE WEB SITE

    We will try to make this web site available but cannot guarantee that this web site will operate continuously or without interruptions or be error free and can accept no liability for its unavailability, You must not attempt to interfere with the proper working of this web site and, in particular, you must not attempt to circumvent security, tamper with, hack into, or otherwise disrupt any computer system, service, web site, router or any other internet connected device.

  12. FORCE MAJEURE

    We shall not be liable for any failure or delay in the performance, in whole or part, of any of our obligations arising from or attributable to acts, events, omissions or accidents beyond our reasonable control including, but not limited to, strikes, lock-outs or other industrial disputes (whether involving our workforce or the workforce of any other party), act of God, war, riot, civil commotion, terrorism, malicious damage, compliance with any law or governmental order, rule, regulation or direction, accident, breakdown of plant or machinery or heating, lighting, air conditioning or telecommunications equipment, fire, flood, storm, pandemics, epidemics or other outbreaks of disease or infection, or failure in the external supply of electricity, water or telecommunications (including internet) connections.

  13. PAYMENT FOR EVENTS

    Payment in full is due no later than 7 days prior to the event date. This may be made via electronic transfer,debit card,credit card,cash or cheque. The company reserves the right to cancel the event if payment has not been received in full. Booking is confirmed only on receipt of 50% of the payment.

  14. INCLUSIONS

    The company will supply all activity equipments, décor deliverables venue costs as detailed in the invoice. Any other extras will be charged on actuals.

  15. SUBSTITUTION

    The company reserves the right to substitute a comparable activity or decor for another in the event of equipment failure or circumstances beyond its reasonable control.

  16. CHANGING DATES

    Every effort will be made to change the event date when requested, although the company reserves the right to charge 10% of the event value. The charge may be higher when it has not been possible to cancel subcontractors or venues. No change may be made within 30 days of the event.

  17. CANCELLATION

    Whether or not payment has been made, if the customer cancels within 4 weeks of the event there is a 100% cancellation fee. Cancellation between 4 weeks and 8 weeks from the event incurs a 50% cancellation fee. Cancellation more than 8 weeks from the event incurs a 15% cancellation fee.

  18. CHANGE IN NO. OF ATTENDEES

    A reduction in the number of attendees does not usually result in a refund and never within 30 days of the event. If numbers are reduced more than 30 days before the event, then every effort will be made to save variable costs such as catering etc.

  19. POSTPONEMENT OF EVENTS

    Due to postponement of events beyond our control the company accepts no liability for consequential losses incurred by the customer such as hotels and flights in the event of postponement or cancellation.

  20. LIABILITY FOR DAMAGE

    The customer is liable for loss or damage caused by guests whilst on the event to boats, vehicles, clothing or other equipment supplied by the company but limited to the amount of the company’s insurance excess.

  21. FEES FOR COURSES

    Full payment of the course fees must be received two weeks prior to commencement of long courses. Your place on the course cannot be guaranteed until 100% of payment is received before start of the course for longer courses.
    For single lesson course 100% of payment must be done atleast 1 week prior before the commencement of class.

  22. OFFLINE OUTSTATION STUDENTS

      Please include contact details for your Bangalore stay when making your booking in case we need to contact you prior to course commencement.
      Please ensure that your booking is confirmed and that the course is running before you make any travel arrangements. We can not offer refunds for travel or accommodation costs

  23. VISAS

      If you do not hold an Indian passport, you may require a visa that allows you entry to India in order to take one of our courses. It is your responsibility to determine how far in advance you need to apply for a visa if it is required, and to allow sufficient time to obtain a visa.
      If you are refused entry to India, you will not be eligible for a refund of course fees.
      If your visa is delayed, you will also not be eligible for a refund of course fees. At our discretion, however, we will consider transferring you to another course at a later date.
      We require a copy of your passport and visa at least two working days in advance of course commencement. We will not allow you to join the course if you do not have the required documentation that allows you entry to India. An electronic copy is sufficient to confirm your place on the course.   24. Cancellations by you

      You may cancel your place on a course up to one month before the course start date. However we do not offer refunds for the course. You may request to shift the course at a later date,this can be done upon mutual agreement but the decision of the school will be final.
      If you wish to cancel within one month of the course start date you will not be entitled to a refund
      If you have purchased a One-week, Two-week or Career Course and wish to cancel within one month of the course start date, you will not be entitled to a refund. However, at our discretion and subject to availability, you may be able to shift the course date on these courses to a later date
      Cancellation requests must be made in writing to team@meghaamodi.com.
      Please note that refunds can take upto three weeks to process.

  25. Cancellations by us

      Please note that courses have minimum attendance levels and may be cancelled if too few bookings are received. We reserve the right to amend or cancel courses
      If we cancel a course we shall endeavour to give you at least one week’s notice. You will have the option of transferring to another course or having a full refund of the fees, which we will return to you within three weeks
      We will not be liable for any losses (including, but not limited to, travel and accommodation costs) arising as a consequence of any modification or cancellation of courses or timetabling constraints as set out above, beyond the cost of the course fee

  26. NON-ATTENDANCE

      If you are unable to attend a class or classes due to illness, or for personal or professional reasons, you will not be entitled to a refund, extra tuition or to automatically transfer to another course. However, we will consider such action that we believe to be fair and reasonable
      Please note that if alternative options are offered, there may be an additional charge

  27. CERTIFICATES

      To achieve a certificate of attendance you must attend at least 100% of the course
      You will be presented with a certificate at the end of the course and the name given on the booking form will be the one that appears on the certificate
      There will be an additional postage charge for certificates sent outside of the Bangalore
      You may also collect your certificate from Meghaa Modi Design Studio by prior arrangement
      Replacement certificates can be produced up to one year after completion of your course, but will be subject to an administrative fee of INR 500/-

  28. MATERIALS AND EQUIPMENT

    All materials and flowers are included in the course fees for offline classes and online classes with supplies in India only.
    Materials list will be provided for online classes without supplies.

  29. PHOTOGRAPHY AND VIDEO

      You may take as many photographs of your own work as you wish during the course.
      Please ask permission of other students before taking photographs of their work, or using their work on your website
      You are not permitted to take videos at Meghaa Modi Design Studio.
      For online classes, you are not allowed to record the online classes at any cost. Legal action will be taken if we find out about the classes being recorded.

  30. STUDENT CONDUCT

    Students are expected to conduct themselves in a professional manner and to recognise that other students also require support and assistance. If a student becomes persistently disruptive, we reserve the right to issue an oral or written warning and, if this does not resolve the situation, we may, at our discretion, ask the student to leave the course.

  31. HEALTH AND SAFETY

    Students are expected to follow Health and Safety guidelines that are given at the start of each course
    Students are asked to wear appropriate clothing and footwear during the course
    Students who fail to comply with Health and Safety rules will be unable to participate in the course

  32. CONFIDENTIALITY

    You agree not to disclose information you obtain from us and or from our clients, advertisers, suppliers and forum members. All information submitted to by an end-user customer pursuant to a Program is proprietary information of Elite Wedding and Event Planning. Such customer information is confidential and may not be disclosed. Publisher agrees not to reproduce, disseminate, sell, distribute or commercially exploit any such proprietary information in any manner.
